validity of terms and conditions

the general terms and conditions of sale, exclusive to kunstdünger ohg des christian walzl & co. (company registered at the court of bozen/bolzano, registration number: 130116 from the 01/06/2002) and valid at the time the order was made, apply to all business relations between kunstdünger ohg and the customer. any amendments to the conditions of sale by the customers, either written or verbal, must be recorded and signed by the supplier before being valid. all quotes are subject to alteration if an official order for the goods specified in the quote has not been received within 30 days. official orders may be placed either by fax, email or telephone but it is only valid once confirmed in writing by kunstdünger ohg

appearance , dimensions and weight outlined in all literature are subject to change without notice.

cancellation

the customer has the right to cancel their order with an immediate notification by email or fax (+39 0473 741600). the supplier (kunstdünger ohg) will confirm the cancellation by fax or email. kunstdünger ohg reserves the right to cancel any orders where the client has an outstanding debt with the company or behaves in a manner unacceptable to the company.

prices

all prices, in the currency indicated, are subject to alteration and are quoted ex works. all delivery costs are additional as well as any obligatory VAT and other taxes. a handling charge of 10 € will be applied to all orders less than 25 €.

delivery

all goods ordered will be prepared for pickup within a timeframe agreed to between the customer and the supplier. all delivery costs, unless agreed differently, will always be at the customer’s expense. loss / or damage in transit needs to be notified to the logistics company immediately upon reception of the goods and the goods should not be signed for. kunstdünger ohg needs to be informed only if the transport was organised by them. if the products the customer has ordered are not available or only partly available, he will be informed immediately via our order confirmation or direct communication. the company kunstdünger ohg des christian walzl & co. reserves the right to cancel any order or part of an order. any extra cost occurred in relationship to urgent supply of goods will be at the customer’s expense. the company reserves the right to withhold supply / delivery if the customer has an outstanding debt; the company kunstdünger ohg accepts no liability for any eventual loss.

property right

the company kunstdünger ohg reserves the ownership of all goods supplied until payment has been received in full for both current and overdue accounts. refund policy the customer has the right to return all goods within 14 days for a refund in full. all goods returned must be in as new conditions and in the original packaging. all freight costs are at the customer’s expense except when the goods are being returned because of a manufacturing error or the wrong goods were supplied. in all cases the supplier needs to be informed in writing before the return of any goods, otherwise the delivery will not be accepted by kunstdünger ohg. this refund policy is not valid for custom manufactured items except where the manufacturer is at fault, in which case the manufacturer (kunstdünger ohg) reserves the right to replace the goods or issue a credit. guarantee and liability all goods are supplied with a twenty-four month guarantee valid from the date of invoicing. if any item is considered to be faulty the customer needs to inform the company, kunstdünger ohg, in writing within 2 weeks of receiving the goods. in the case of guarantee claims, the company kunstdünger ohg has the right to choose to either repair the item(s), deliver a replacement, or refund the purchase price in full. if the company can neither repair or replace the defective item(s), the customer has the right to cancel the contract or to request a reduction in the invoice value. all guarantees and liability are only valid for goods damaged by the supplier, his employees or contracted third parties.

copyright

kunstdünger ohg des christian walzl & co. reserves all copyright on all drawings, samples, pictures, concepts, graphics and any printed or electronically published material. any use of such materials is only possible with the full written agreement of kunstdünger ohg. before publication, either electronic or printed, a final proof must be signed of by an appropriate representative of kunstdünger. kunstdünger ohg accepts no responsibility for the infringement of any copyright when manufacturing items on behalf of a third party. product updates the products supplied may vary from those illustrated in any published media. the company reserves the right to deliver updated products. terms of payment

only current published prices, at the time of purchase, are valid. credit card payments will be debited at the date of despatch. changes to invoice values not approved by kunstdünger ohg will remain as overdue on the customer’s account. the company reserves the right to charge interests on all overdue accounts. all overdue accounts will be passed to our collection agency / lawyers following the date indicated in our fourth demand notice.

privacy / data protection

kunstdünger ohg guarantees that all the information collected in the course of completing all contracts is subject to the highest security and we are committed to protecting that data from unauthorised access by a third party. for further information about data protection, see the following page under privacy. conclusion if one or more of the general terms and conditions of sales, listed above, becomes void, the validity of the other terms will not be affected. the affected term will be replaced by another appropriate legal condition. the court of jurisdiction is in bolzano/bozen (I) and the italian law will be applicable. the german language version of the general terms and conditions of sale carries legal validity. company management kunstdünger is managed by the owners of kunstdünger ohg des christian walzl & co.
